WORD Service Terms and Conditions
General
The following conditions form the basis of the agreement to provide text and translation services to clients. By submitting a Word+Image order form and/or by providing written confirmation of any quotations, the client expressly acknowledges to have read, understood and accepted these conditions. If Word+Image waives any of these terms on an individual basis, this shall neither affect the validity of remaining clauses nor commit Word+Image to waive the same clause on any other occasion.
Contact partner
Contact Word+Image to discuss administrative aspects of assignments, such as price, deadlines, billing, capacity, etc. Contact with the individual service providers under contract to Word+Image is possible to clarify details of specific assignments, however, only after the assignment has been submitted to the Word+Image central administration.
Business hours
Though we operate the website www.wordandimage.ch and our other linked websites on a 24/7 basis, our local business hours are from Monday to Friday, 8:00 am to 6:00 pm, CET Switzerland. Our telephone is answered between these hours, and messages can be left outside business hours. We can be reached 24 hours a day, 7 days a week per e-mail, but messages are generally responded to within business hours. The Word+Image website is available 24 hours a day, 7 days a week (except for maintenance times) for information and order placement. We have translators all over the world and so your text could be processed at any time.
Service guarantee
Access to the services listed here are guaranteed from Monday to Friday during the normal business hours (see Business hours), at the capacities generally applicable to the industry and at the rates listed above (including any applicable service charges). Availability outside the normal business hours, on weekends and holidays (with applicable rates) can be arranged in special agreement, however, cannot be guaranteed.
Copyright / Legal guarantee
If the client is charged with a copyright violation as a result of a translation or text delivered by Word+Image Inc., then the client is obligated to compensate Word+Image Inc., as well as any external language experts for damages incurred, including legal fees.
Notary
Translations from Word+Image Inc. can be notarized upon request. Notarized will be a statement that the text has been translated to the best of the translator's knowledge and experience and an authorized Word+Image Inc. signature. The content and accuracy of the text cannot be notarized. The time required for the notarization, as well as any applicable fees, will be billed to the client.
Delivery
Unless otherwise instructed by the client, text and translation assignments will be delivered to the client's e-mail address. If no e-mail address is provided, or if another form of delivery is requested, the assignment will be delivered per fax, via the postal service or per courier, according to client request. Assignments are considered complete upon transfer to the postal service or courier, or a with a time-stamped e-mail dispatch. The customer is responsible for confirming receipt of the completed documents. All delivery costs resulting from client requests are borne by the client, including postage and other mailing and courier services. Word+Image Inc. does not assume liability for the delivery of assignments by third parties, nor for the successful delivery of e-mail once dispatched. Word+Image Inc. assumes no liability for third-party systems, browser or IT infrastructure.
Liability for translations and complaints
If no specific instructions or documentation are provided in advance, specific industry terms will be applied according to general usage. No liability can be assumed for translation errors caused by inaccurate or incomplete information, erroneous or imprecise original text. The client is responsible for the proofreading and editing of the original text. Word+Image Inc. can provide proofreading and editing services for source texts upon request. Complaints regarding completed assignments are to be made within 10 working days after delivery to the customer. No liability is assumed by Word+Image Inc. for the accurate reproduction of names and titles in languages and letter characters outside the languages offered, nor for source text that is hand-written, scanned or illegible.

Accuracy guarantee
We guarantee the accuracy of your translations. Word+Image Inc. selects the best native specialists for the subject area of your text. All our translators have at least five years of professional experience and hold a recognized translator’s degree or an advanced diploma in translation, and/or a specialist diploma in the relevant technical field. As part of our service to ensure optimal end quality, the translation of your document is proofread by a second native professional.
Free error correction
Word+Image Inc. warrants the correctness of its translations. Word+Image Inc. will correct mistakes or errors that are clearly and unequivocally committed by Word+Image Inc. at no charge to the client. However, if corrections are based on the client’s preference of style and/or terminology or in the event that there is more than one way to interpret the meaning of a source text, Word+Image Inc. shall not have an obligation to correct mistakes or errors at no charge, unless preferences of style and/or terminologies have been communicated to Word+Image Inc. prior to the start of the translation. Should the seriousness or number of changes or corrections warrant it, we will have a supplementary proofreading of your translation done by another native specialist at our own expense. Following delivery of your translation, you have a 10-day period to lodge any justified complaints by e-mail.
Punctuality guarantee
If you order an express translation, editing or proofreading, we guarantee to deliver your text within the agreed upon and confirmed deadline. Should we fail to deliver on time, the express surcharge shall be waived.
Confidentiality / Security
All assignments are handled by Word+Image Inc. with the strictest confidentiality. All Word+Image team members are obligated by signed bank, Post and business secrecy agreements. The security agreements concluded between Word+Image Inc., its team members and partner companies can be viewed by customers upon request.
Assignments are generally submitted over the Internet or sent per e-mail. Documents requiring a higher standard of security can be sent encrypted, and/or digitally signed by means of digital certificates. SSL-protected FTP transmission is also available upon request. The Word+Image main computers and databases are protected from unauthorized access through passwords and firewalls. All e-mail transmissions are filtered through virus protectors. Regular backups of archived files are made to data carriers and placed in secure storage. All paper documents with sensitive data are either returned to the client when they are no longer needed, stored in a secure location or destroyed.
Loss
Word+Image does not bear responsibility for text and documents provided by the client which become lost or damaged as a result of break-in, theft, fire, water, storm, acts of God, war, terrorism, vandalism, electronic tampering or loss by the postal service or courier.
Cancellation of assignments
If the client cancels an assignment placed with Word+Image, then all costs incurred up until the time of cancellation, including consultation and administration, and third-party services, are invoiced.
Billing
Assignments are billed upon delivery. Monthly billing can be arranged upon request and always occurs in the last week of the month in which the respective services are provided. Central invoicing of multiple companies, branches, business units, departments or project group on the basis of cost centers is available upon request. All bills are to be paid within 30 days, net.
Deposit for new clients
Word+Image Inc. may require a deposit for new clients amounting to 50% of the estimated cost of the first assignment.
Applicable law / Court of jurisdiction
Swiss law is applicable for all disputes pertaining to services provided by Word+Image Inc., its service providers and partner companies. The court of jurisdiction is Zufikon, Switzerland.
Acknowledgment of the Word+Image Business Conditions
By submitting the Word+Image order form or otherwise placing an assignment, the client expressly acknowledges that he/she has read, understood and accepted the Word+Image Business Conditions.
Order form
Text and translation orders can be placed 24 hours a day. Simply click on the order form icon and complete with your specifications. Please note that fields marked with an asterisk are mandatory. The form can also be saved to your hard drive, be printed out, saved or attached to orders. We recommend that you save or print out the order form for you own reference. We will confirm your order per e-mail. You can request that we contact you for a specific quotation before we start the assignment.
Special conditions for glossary services
Source terms
The customer provides the original list of terms to be added to the glossary. The list can be in any of the Word+Image languages, and may or may not include definitions. We can provide definitions of terms upon request for the source terms as well as the translations.
Consultation
To set up a glossary requires considerable initial consultation with the customer. Consultation may take place on the telephone, Skype or in person. The initial consultation is free of charge until an offer is made. Subsequent consultations shall be billed at our hourly rate.
Glossary maintenance
Word+Image Inc. offers glossary maintenance services that can be set up to meet the customer’s individual needs. Maintenance includes the adding, defining and translation of new terms, further research or revision of existing terminology and user-generated inquires and administration. This includes the managing of user rights for online glossaries.
Hosting fees
If Word+Image Inc. hosts your glossary on its server, then a monthly hosting fee shall be charged according to the space required. Rates are disclosed in our offer.
Domains
If the customer obtains online glossary services from Word+Image Inc., they are responsible for providing and maintaining the domain name. Such domain names remain the property of the respective customer.
Intellectual property
The terms, definitions and translation of glossaries obtained by the customer remain the intellectual property of the customer as long as such has been paid for. The code used to create the Word+Image Inc. glossary service and specific customer glossaries remains the property of Word+Image Inc. The customer is entitled to copy, link or export their glossary according to the rights they have authorized internally.
Access rights
For online glossaries, the customer is responsible for assigning access rights to their specific glossary. The administration of such rights is carried out by Word+Image Inc. upon the express orders of the customer. Word+Image Inc. assumes no liability for such access and rights allocation.
Liability
Word+Image Inc. strives to provide accurate definitions and translations of the terms listed in our customer glossaries. The customer is ultimately responsible for ensuring that their glossaries are accurate. Word+Image Inc. will correct any justified erroneous entries in a glossary it has created and/or maintains free of charge upon request, after review by our team of language experts.
